       PROVIDING FOR CONSIDERATION OF THE BILL (H.R. 648) MAKING 
 APPROPRIATIONS FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 2019, AND FOR 
  OTHER PURPOSES; PROVIDING FOR CONSIDERATION OF THE JOINT RESOLUTION 
    (H.J. RES. 31) MAKING FURTHER CONTINUING APPROPRIATIONS FOR THE 
  DEPARTMENT OF HOMELAND SECURITY FOR FISCAL YEAR 2019, AND FOR OTHER 
PURPOSES; PROVIDING FOR CONSIDERATION OF MOTIONS TO SUSPEND THE RULES; 
 AND WAIVING A REQUIREMENT OF CLAUSE 6(A) OF RULE XIII WITH RESPECT TO 
  CONSIDERATION OF CERTAIN RESOLUTIONS REPORTED FROM THE COMMITTEE ON

                              R E P O R T

                       [To accompany H. Res. 61]

    The Committee on Rules, having had under consideration 
House Resolution 61, by a record vote of 6 to 2, report the 
same to the House with the recommendation that the resolution 
be adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    The resolution provides for consideration of H.R. 648, the 
Consolidated Appropriations Act, 2019, under a closed rule. The 
resolution provides one hour of debate equally divided and 
controlled by the chair and ranking minority member of the 
Committee on Appropriations or their designees. The resolution 
waives all points of order against consideration of the bill. 
The resolution provides that the bill shall be considered as 
read. The resolution waives all points of order against 
provisions in the bill. The resolution provides that clause 
2(e) of rule XXI shall not apply during consideration of the 
bill. The resolution provides one motion to recommit. The 
resolution provides for consideration of H.J. Res. 31, Making 
further continuing appropriations for the Department of 
Homeland Security for fiscal year 2019, and for other purposes, 
under a closed rule. The resolution provides one hour of debate 
equally divided and controlled by the chair and ranking 
minority member of the Committee on Appropriations or their 
designees. The resolution waives all points of order against 
consideration of the joint resolution. The resolution provides 
that the joint resolution shall be considered as read. The 
resolution waives all points of order against provisions in the 
joint resolution. The resolution provides one motion to 
recommit. The resolution provides that it shall be in order at 
any time through the legislative day of February 1, 2019, for 
the Speaker to entertain motions that the House suspend the 
rules and that the Speaker or her designee shall consult with 
the Minority Leader or his designee on the designation of any 
matter for consideration pursuant to this section. The 
requirement of clause 6(a) of rule XIII for a two-thirds vote 
to consider a report from the Committee on Rules on the same 
day it is presented to the House is waived with respect to any 
resolution reported through the legislative day of January 30, 
2019, relating to a measure making or continuing appropriations 
for the fiscal year ending September 30, 2019.

                         EXPLANATION OF WAIVERS

    The waiver of all points of order against consideration of 
H.R. 648 includes waivers of the following:
           Section 302(f)(1) of the Congressional 
        Budget Act, which prohibits consideration of 
        legislation providing new budget authority in excess of 
        a 302(a) or 302(b) allocation of such authority.
           Clause 12(a)(1) of rule XXI, which prohibits 
        consideration of a bill unless there is a searchable 
        electronic comparative print that shows how the bill 
        proposes to change current law.
    Although the resolution waives all points of order against 
provisions in H.R. 648, the Committee is not aware of any 
points of order. The waiver is prophylactic in nature.
    The waiver of all points of order against consideration of 
H.J. Res. 31 includes waivers of the following:
           Clause 12(a)(1) of rule XXI, which prohibits 
        consideration of a bill or joint resolution unless 
        there is a searchable electronic comparative print that 
        shows how the bill or joint resolution proposes to 
        change current law.
           Clause 11 of rule XXI, prohibiting the 
        consideration of a bill or joint resolution which has 
        not been reported by a committee until such measure has 
        been available to Members, Delegates, and the Resident 
        Commissioner for 72 hours.
    Although the resolution waives all points of order against 
provisions in H.J. Res. 31, the Committee is not aware of any 
points of order. The waiver is prophylactic in nature.
